need to do — in order.

Becoming a landlord unexpectedly doesn't exempt you from the law. These eight steps, in this order, will get you legal and protected.

Protect the tenancy deposit

You have 30 days from the date the deposit was paid to register it with a government-approved scheme (DPS, MyDeposits, or TDS). Missing this window means a court can award your tenant up to 3× the deposit value — on top of returning it.

Penalty: up to 3× deposit, plus loss of Section 21 rights (already abolished — but the penalty survives).

Serve prescribed information to your tenant

Once the deposit is protected, you must serve your tenant with the scheme's prescribed information and the government's How to Rent guide (RRA information sheet). This is mandatory even if the tenancy started informally.

Penalty: any possession claim becomes much harder; courts can refuse to hear it.

Check the gas safety certificate (CP12)

A valid Gas Safe-registered engineer must inspect all gas appliances annually. You need a current CP12 certificate. If you inherited a tenancy from a previous landlord, check when it was last done — it may have lapsed.

Penalty: criminal prosecution, HSE investigation, and tenant can report you immediately.

Check the Electrical Installation Condition Report (EICR)

An EICR is required every five years (or on a change of tenancy). It must be carried out by a qualified electrician. If the property was inherited or recently vacated, there may be no record at all — treat this as urgent.

Penalty: up to £30,000 fine; fine raised to £40,000 from May 2026.

Check the Energy Performance Certificate (EPC)

The property must have an EPC rating of E or above. A rating of F or G means you cannot legally let it without an exemption. The minimum standard rises to C by 2030 — but you need to know where you stand now.

Penalty: up to £5,000 fine; you cannot legally advertise or let the property.

Check your mortgage — do you need consent to let?

If the property still has a residential mortgage and you didn't originally intend to let it, your lender almost certainly requires you to either switch to a buy-to-let product or obtain formal consent to let. Renting without permission is a breach of your mortgage terms.

Risk: lender can demand immediate repayment or repossess. Check before a tenant moves in.

Understand Section 8 eviction grounds

Section 21 no-fault eviction is abolished from May 2026. You can only end a tenancy using Section 8, which requires specific grounds — rent arrears, property damage, anti-social behaviour, or intent to sell. You must be fully compliant before serving any notice.

Risk: defective notice is void; court will dismiss your claim and award tenant costs.

Register for the Private Rented Sector (PRS) database

Mandatory landlord registration for England is expected to go live in late 2026. Wales and Scotland already have registration requirements. Getting set up early means you won't scramble when enforcement begins.

Penalty: fines and enforcement action; unregistered landlords cannot serve valid Section 8 notices.
